Legal bods...

Any ideas to put forward on this....

One of the tenants ( a business btw) in the place I work has gone and got themselves bankrupted / insolvency stuff.

The office they were using is complete with desks, files, safes, computers etc - they just had to get up, walk out and shut the door. Despite repeated requests we've heard nothing from the 2 guys that owned the company for over 6 months - the last contact anyone had with either of them was that guy confirming that since he had been made bankrupt he has nothing more to do with the place now. Prior to being booted out they owed a ton of rent to our place.

So... here's the deal.

From an "intellectual property" point of view - anyone got any ideas in terms of our responsibilites as the landlord? as basically we are at the point of hiring a skip and chucking everything in it. I was wondering what would happen if say one of the original owners (or someone else in a legal capacity in relation to their bankruptcy) came to us and wanted to know what happened to the data (or even perhaps the actual hardward) on the computers.

Management here are thinking we could make use of them so ..... any thoughts?

They belong to the administrators, you'll need to contact them, maybe make a silly offer, they probably just want rid of the crap, or offer to reduce the rent owed by 10% for the contents of the rooms.

hmm actually got some more info on this....

Seems 1 guy was made bankrupt, the other has simply "walked away" from the business (didn't want to be left to deal with the debts).... the limited co is still active - there are no "administrators"

As I said, the owe a shit of rent so the likely chances if either of them coming back is remote to say the least.

In that case you need to take the company to court. If it wasn't wound up correctly there are bound to be tons of other creditors. The one who walked away also needs to sort it out.

Have you checked the company details at Companies House?

Was the one guy made Bankrupt personally and not the LTD company?

yes it was the guy personally, not the company.

the company is still listed as active but the sole director who was left has basically "done a bunk".
