But the fundamental nuance is that the burden of proof is so much higher in a criminal trial (and I'm fine with it being lower for a footballing disciplinary panel), with the effect that the rule effectively exists for civil cases.

In employment law they do no have to prove beyond reasonable doubt, they have to prove the balance of probability iirc. Let's be honest it's highly probable that Terry was guilty, being the cock that he is and the evidence presented.

One would think that the word "black" in the context of a supportive statement against a charge of racism would be kind of high up the list of things not to "forget".

Terry has been found to have racially abused another player and then aggravated the offence by trying to brazen his way out of taking responsibility for it, however out of character it may have been. This man is still the captain of the European champions and Premier League table-toppers, a club which professes to have a zero tolerance approach to racism.

To find ANYTHING positive in any of this is impossible.

Rugby is a contact sport for big, powerful men (even the small players are relatively big!) Football isn't.

Like so many of friends I am quite frankly bored of the all the fucking cheating in the 'game'. When I grew up footballers ued to show sportsmanship now it so bloody rare that when they do we act shocked. For example the German goal keeper who snuck the ball back over the line after Lampard scored should after video evidence have been banned from the game.

The point which is a fair one is that how often do you see a player literally only brushed and he goes over like he's been shot in the gut. They get lightly touched on the elbow and go down clutching their face, it's pretty pathetic and you'll struggle to find a game where it doesn't happen.

Aye rugby is a more physical game but equally footballers are athletes and not of the Mo Farah build. You wouldnt expect them to take a rugby tackle or a big hit running for a try , but they shouldn't be acting like 4 years olds who wanged their noggin when the sole intent is for a free kick / penalty / card for opposing player.
