Edit: I don't have kids yet so I guess that may alter my opinion a bit.

Difficult one this. I'd certainly give the guy a shit kicking but I don't think I'd set out to try and kill him. Of course I might not be able to control myself in that situation, I've never been in it so it's an unknown.

Not much detail is known about the actual event so it's not clear whether it was a 'lucky' strike or two that killed him or whether the father properly went to town until he was dead. Seeing as he rang the emergency services and said "hurry up, this guy is dying on me" (words to that effect) it seems he probably didn't intend to kill him.

Although I'm not particularly bothered in the knowledge that the rapist died I find it a bit disturbing reading all the comments at the bottom from people so eager to dish out the death penalty. Murder is still the larger crime here and despite the inherent weaknesses of western legal systems I still stand by its principals.

What does everyone else think?

Glad he didnt get convicted, I think any normal man would loose the the plot seeing his little girl being raped.

Aye, I guess that's how the Texan legal system saw it. Hopefully they took into account the fact that banging up the father and subjecting his family to more heartache for x years wasn't really justified given the circumstances.

If he had just ruthlessly murdered the guy, it may well have been a different matter, but the fact is that he showed remorse immediately and phoned for the emergencry services asking for help.

See, I read this story a couple of weeks ago and I thought, like most people do, that he was quite right and the other guy should burn in hell, etc.

But... It wasn't really made clear if there was any other witness to this scene, therefore he could have made this story up to justify the killing knowing how most people would respond to his story.

The right to defend yourself and your family is a very basic human right, killing the guy was a step too far but understandable and given the remorse and efforts he made to contact the emergency services it's a relatively safe assumption that his intention wasn't to kill.

I think if that was one of my kids I wouldn't have stopped until I knew the cunt was very very dead.

Completely side on with the farther on this one, if any sick puppy rapes a child they deserve a quick brutal end.

From what i read on a us site the farther has stated he just lost it and the judge found no intent was evident. If he had pulled a gun and slotted the fucker then yes it may wanted further action but a momentary loss of control when faced with such an act to your own kin makes me feel sorry for the farther and even more for the poor child.

The farther now must live with his actions and the poor girl will suffer for years, thats worse then any prison sentance.

gun wouldn't have been an issue in the US, within the home, stopping a rape. he didn't mean to kill him and tried to save his life after. police seemed to understand.

gun would have helped being farther away, he got up close and personal. hopefully the girl will forget being so young

Gun though tempting would have been too risky - the chances of your daughter getting hit are not worth it - even a direct hit on the guy doesn' t mean she wouldn't take a round (bullets do odd things when moving through bodies - like bouncing off bones and changing direction).

Only way to be sure is to be up close and personal, physically heave the guy off and then waste the fucker.

Problem with this though is you run the risk of losing your advantage and the gun being turned on yourself in the struggle.

I can't honestly see that any jury would have found him guilty - even if he hadn't called the cops. Anyone seeing their next of kin being attacked in this way - would i'm sure fucking loose it completely - and it's made worse by the age of the poor kid.
